Terms of Service

The agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Purple Peppercorn Pty Ltd (ABN 35 698 539 123 · ACN 698 539 123), trading as Amperly (“Amperly”, “we”, “us”, or “our”), governing your access to and use of the Amperly platform at amperly.com.au.

By creating an account or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Community Standards, which are incorporated into these Terms by reference.

If you do not agree with any part of these Terms, do not create an account or use the platform.

Eligibility

To use Amperly you must:

  • Be 18 years of age or older — we verify this at registration using your date of birth
  • Be a resident of Australia or legally permitted to access Australian online services
  • Not have been previously banned or suspended from Amperly under these Terms
  • Have the legal capacity to enter into binding contracts under the laws of New South Wales

If we discover that an account belongs to someone under 18, we will immediately suspend and delete the account without notice and refer the matter to the appropriate authority where child safety is at risk.

Australian Online Safety legislation

Amperly is an 18+ platform. We are aware of and operate in compliance with the Online Safety Amendment (Social Media Minimum Age) Act 2024 (Cth), which requires age assurance measures for social platforms accessible to minors. Because Amperly is strictly 18+, we are not a “designated social media platform” under the Act — however we proactively apply age verification standards that meet or exceed the Act’s intent.

Our age assurance measures include:

  • Date of birth verification at registration — all accounts must provide a date of birth confirming they are 18 or over before access is granted
  • Immediate removal — any account determined to belong to a person under 18 is suspended and deleted within 24 hours of discovery or report, with no data retained
  • Zero tolerance for child exploitation content — any such content results in immediate permanent ban and mandatory referral to the Australian Centre to Counter Child Exploitation (ACCCE) and the Australian Federal Police (AFP)
  • No under-18 data collected or retained — we do not knowingly collect, store, or process personal information from anyone under 18

We monitor ongoing regulatory developments under the Online Safety Act 2021 (Cth) and guidance issued by the eSafety Commissioner, and update our practices as requirements evolve. For online safety compliance enquiries, contact legal@amperly.com.au.

Your account

Registration

You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the accuracy of this information.

Security

You are responsible for maintaining the security of your account credentials. Do not share your password with anyone. Notify us immediately at safety@amperly.com.au if you believe your account has been compromised.

One account per person

You may only maintain one Amperly account. Creating multiple accounts to evade a ban or exploit free-tier features is a material breach of these Terms.

Account accuracy

Your profile name, photo, and bio must represent you as an individual. Impersonating another person or creating a profile that is intentionally misleading is prohibited under our Community Standards.

Conduct

By using Amperly you agree not to:

  • Post, share, or transmit content that is illegal under Australian law
  • Harass, threaten, intimidate, or abuse other members
  • Impersonate any person or entity
  • Use the platform for commercial solicitation, spam, or unsolicited advertising
  • Distribute malware, phishing links, or any malicious code
  • Attempt to access another member’s account without authorisation
  • Scrape, harvest, or extract user data from the platform by automated means
  • Interfere with or disrupt the integrity or performance of the platform
  • Circumvent any technical measures we use to enforce these Terms

Our Community Standards provide more detailed guidance on prohibited behaviour and how we enforce these rules.

Your content

Ownership

You retain ownership of all content you post on Amperly — your messages, photos, stories, and profile information.

Licence to us

By posting content on Amperly, you grant Purple Peppercorn Pty Ltd a non-exclusive, royalty-free, worldwide licence to store, display, and transmit that content solely for the purpose of operating and providing the Amperly service. This licence ends when you delete the content or close your account.

Your responsibility

You are solely responsible for the content you post. You warrant that your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.

Content removal

We reserve the right to remove any content that violates these Terms or our Community Standards, without notice and without liability to you.

Payments and subscriptions

Amperly Plus subscription

Amperly Plus is a recurring subscription at $12.99/month (or the equivalent annual rate), billed via Stripe. By subscribing, you authorise us to charge your nominated payment method on each billing date until you cancel.

Founding Member rate

The Founding Member rate of $6.99/month is available only during the founding period and is locked for the life of your subscription while it remains active.

Important: If you cancel a Founding Member subscription, you permanently and irrevocably lose access to the $6.99/month rate. Re-subscribing after cancellation is at the then-current standard rate ($12.99/month as at the effective date of these Terms). This cannot be reversed.

One-time purchases

One-time purchases (such as the “See Who Viewed” unlock or Profile Boost) are non-refundable once the feature has been delivered or activated.

Price changes

We will provide at least 30 days’ notice of any price increase to existing subscribers via email. Continued use of Plus after the effective date of a price change constitutes acceptance.

Failed payments

If a payment fails, we will retry the charge up to three times over seven days. If payment cannot be collected, your Plus subscription will be downgraded to the free tier until payment is resolved.

GST

All prices displayed on the platform are inclusive of Australian Goods and Services Tax (GST) where applicable.

Cancellation and refunds

Cancelling your subscription

You may cancel your Plus subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain Plus access until that date. We do not provide prorated refunds for partial months.

Refunds

Under Australian Consumer Law, you may be entitled to a refund if the service is not as described or fails to function as advertised. Contact legal@amperly.com.au for refund requests. We assess each request on its merits and in accordance with our obligations under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

Account deletion

You may delete your account at any time from profile settings. Account deletion cancels any active subscription immediately (no refund for unused time) and triggers deletion of your personal data within 30 days, as described in our Privacy Policy.

Plus features

Amperly Plus ($12.99/month) provides access to additional features including but not limited to:

  • Unlimited new DM conversations (free tier: 10 per day)
  • See who viewed your profile — full list
  • Incognito browse — your profile views are not visible to others
  • Profile Boost — 2 free boosts per week
  • 3 stories per day (free tier: 1 per day)
  • 6 profile photos (free tier: 3)
  • Ad-free experience

The specific features included in Plus may change over time. We will give subscribers 14 days’ notice before removing any material feature from Plus.

Termination

By you

You may close your account at any time from your profile settings.

By us

We may suspend or terminate your account immediately and without notice if you:

  • Breach any provision of these Terms or our Community Standards
  • Engage in conduct that we reasonably believe poses a risk to other members or to the platform
  • Provide false information at registration, including misrepresenting your age
  • Fail to pay any amounts due for a Plus subscription after repeated attempts

Serious violations — including posting illegal content, harassment, or impersonation — may result in immediate permanent termination without the opportunity to appeal.

Effect of termination

On termination, your right to access the platform ceases immediately. Your content will be deleted within 30 days. Any unused portion of a prepaid subscription is non-refundable unless required under Australian Consumer Law.

Limitation of liability

To the maximum extent permitted by Australian law, Amperly and Purple Peppercorn Pty Ltd will not be liable to you for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, loss of data, or loss of goodwill, arising from your use of the platform.

Our total aggregate liability to you for any claim arising out of or related to these Terms or your use of the platform will not exceed the total amount paid by you to Amperly in the 12 months preceding the claim, or $100 AUD, whichever is greater.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law, including any guarantee that cannot lawfully be excluded.

Disputes

Before bringing any legal claim, you agree to contact us at legal@amperly.com.au to attempt to resolve the dispute informally. We will respond within 14 business days.

If informal resolution fails, either party may refer the dispute to mediation under the Australian Disputes Centre Rules before commencing court proceedings.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with these Terms, without prejudice to our right to seek injunctive relief in any jurisdiction.
